Sarasota Democrat Candidate for District 72 State House Seat Edward James III Denies Sexual Assault Accusation at Ritz Carlton Hotel But Victim Claims Rape attempt. It appears that James and his friends were trying to coerce the victim into not pressing charges, “A report from the State Attorney’s Office said the woman’s boyfriend told police that James’ friend tried to discourage the victim from reporting the assault because the defendant is running for political office.” According to the Sarasota Police Report filed on Edward E. James DOB 11/05/1989, “When the victim called 911 James told the victim please don’t call the police, she kicked James out of the hotel room and stayed on the line with dispatch until officers arrived.” The woman told police she showered and fell asleep on the hotel bed in a bathrobe. She said she “woke up and felt James’ hand inside of her vagina.” “James crawled on top of (the alleged victim) and told her that he was going to have sex with her,” according to her police statement, which adds that her bathrobe had been removed and James also was naked.

Florida state laws currently include rape under the offense of “sexual battery.” The relevant statutes no longer give a separate legal definition for rape. To prove a rape offense, a prosecutor must establish each of the elements for sexual battery given by state law. As required by the Florida statute on sexual battery, the prosecutor must show that the defendant engaged in oral, vaginal, or anal penetration of the victim with a sexual organ or another object which would appear to include digital penetration of the women’s vagina.

SARASOTA HERALD TRIBUNE — State House candidate Edward James III was accused of sexually assaulting a young woman at a Sarasota hotel in June, according to law enforcement documents obtained Thursday by the Herald-Tribune. A report from the State Attorney’s Office says the woman called 911 to report that James “tried to rape” her. James, a Sarasota Democrat who is running for the District 72 state House seat covering northern Sarasota County, denied the accusations, telling police the act was consensual. He was not arrested and did not face charges after the alleged victim declined to pursue the case and prosecutors concluded there was “insufficient evidence” to proceed. A report from the State Attorney’s Office said the woman’s boyfriend told police that James’ friend “tried to discourage the victim from reporting the assault because the defendant is running for political office.” Dem. Edward James is running for District 72 State House against Rep Alex Miller. Local Democratic leaders said the accusations are serious enough that Edward James should drop out of the race. The Sarasota County Democratic Party withdrew its support for James and called on him to step down. READ THE POLICE REPORT:

“Respect for women, regardless of political party, is a shared value of all Americans,” the party wrote in a press release. And even though James was not charged with a crime, the police report raises questions about his account, noting he initially seemed to indicate he “understood” why the alleged victim was calling 911 but later said he was “shocked.” The report describes that response as “one of the larger ‘red flags’ in the case.”  The incident came to light after the Herald-Tribune, acting on a tip, requested police records documenting the investigation. There were no court filings because James was never arrested or charged. Sarasota police did not issue a news release “because this case did not result in an arrest,” said department spokeswoman Genevieve Judge.

According to the police report, James’ alleged victim is a college student who was visiting her parents and is friends with one of James’ friends. The woman invited James’ friend to stop by her hotel room at the Ritz Carlton in downtown Sarasota, and the friend invited James to join them. The group – which also included the alleged victim’s boyfriend – had dinner at the Jack Dusty restaurant in the Ritz before visiting downtown bars and going to the hotel. The woman told police she showered and fell asleep on the hotel bed in a bathrobe. She said she “woke up and felt Edward James’ hand inside of her vagina.” “James crawled on top of (the alleged victim) and told her that he was going to have sex with her,” according to her police statement, which adds that her bathrobe had been removed and James also was naked. She “told James no several times and stated that she had to push James off of her several times.” “She started calling 911 as she pushed him towards the door of the hotel room,” according to her police statement.
