SARASOTA HERALD TRIBUNE: The U.S. Supreme Court has denied an appeal by Delmer Smith, convicted in the 2009 death of Kathleen Briles at her Terra Ceia home. The U.S. Supreme Court decision not to hear Smith’s case came on Monday. His attorneys had petitioned the court to hear his case in October.
In July, the Florida Supreme Court had denied an appeal from Smith on his conviction and death sentence. Smith, who was convicted in August 2012, has argued that should have been acquitted because his case was based on circumstantial evidence, that a circuit judge erred in not granting him a mistrial, that one of the witnesses in the case should not have been allowed to testify,and that a continuance should have been granted during the case and the judge erred in sentencing. He also has challenged the constitutionality of Florida’s death penalty and the proportionality of a sentence of death in the case.
SARASOTA HERALD TRIBUNE REPORTED: On April 5, 2009 Georgann Smith, 37, was beaten and killed in her home in the 2100 block of Jo-An Drive, not far from Stickney Point Road. Friends found her body on the floor. Like the victims in the other home invasions, Georgeann Smith lived alone. FBI agents and Florida Department of Law Enforcement officials are helping local detectives track the man (Delmer Smith), who is suspected in as many as nine attacks during the last two months. On March 14, a 62-year-old woman was watching TV on Carmilfra Way, near Phillippi Creek, when a robber sneaked in and hit her on the head. Delmer Smith is a degenerate burnout who spent half of his adult life in the joint, he is over the top violent and beat his mostly elderly female victims to a bloody pulp. State Prosecutors have convicted Delmer Smith of numerous home invasions and the murder of Kathleen Briles in Manatee County, Delmer beat her to death with a cast iron sewing machine. Delmer will most likely get the needle for the murder of the Briles woman, but there is “one last thing”.
As of July 27th, 2011 I was aware that; Sarasota Cops Have DNA Evidence That Links Serial Rapist Delmer Smith to Murder of Georgeann Smith But State Attorney Won’t Charge. In what must be the most gutless move ever by the State Attorney’s Office in Sarasota Fl, they have so far refused to charge serial rapist and murderer Delmer Smith with the rape and brutal baseball bat murder of Georgeann Smith even though cops have found touch DNA of Delmer Smith in Georgeann’s house. Does the State Attorney’s office think that serial rapist and murderer Delmer Smith just happened to stop by Georgeann Smith’s house for a drink and a visit, she had no prior connection to this mad dog. From the beginning of Delmer Smith’s reign of terror in the Sarasota-Bradenton area I had been adamant about his link to the murder and rape of Georgeann Smith on JoAnn Drive in Sarasota Fl.

Sarasota-Bradenton Rapist Serial Killer Delmer Smith had his hands full with GeorgeAnn Smith, she was a fighter, she was not going to take it lying down, she more than likely pulled off his mask, she was a black belt in karate trained in self defense but going up against an armed intruder who obviously had no qualms about maiming, or now, killing a woman. GeorgeAnn Smith was a hero, she fought back against Delemer Smith, it may have cost her life, but there is no second guessing the situation, she was attacked and she defended herself, no black belt in karate (an expert in martial arts) is going to accept a hit in the head and possible sexual abuse without fighting back, it is just that simple. Delmer Smith has not been charged in the case.
FROM Georgeann Smith’s sister July 27th, 2011…They linked Delmer Smith to being in my sister’s (Georgeann Smith) home. I received a call earlier in the day and it was confirmed by the Detectives. The bad part is they can’t link him to her murder, because there is no evidence to prove it. The Lead detective re-submitted a piece of evidence to forensics to have a special test performed and that was the link. They found his DNA! I just don’t understand why we have to go through this. Yes, I’m very happy that he is behind bars, but I want his name in BIG BOLD LETTERS on a newspaper clipping saying that he was the one who BRUTALLY MURDERED Georgann, with a beautiful picture of her off to the left.
