“These documents have been presented in court before judges as actual assignments of mortgages and have later been shown to be legally inadequate and/or insufficient,” the website states. The Herald-Tribune first cast light on Florida Default Law Group last year with reporting on foreclosures in Sarasota County, where attorneys for lenders reportedly gave false statements in court about who owns mortgages or whether they have completed all the legal steps to put a foreclosed house back on the market.

You see all these documents time and time again which on their face are not possible,” Tampa attorney Matthew Weidner said. “The judges cannot just ignore this. They cannot ignore blatant fraud in front of their faces.” The Attorney General’s office opened its investigation into Florida Default in October 2009, but it only became public after the target of the investigation was told about it.
The Attorney General can file a lawsuit against the company if it finds wrongdoing, seeking sanctions like fines or injunctions to stop the behavior. Twelfth Judicial Circuit Chief Judge Lee Haworth said news of the investigation could prompt judges in Sarasota and Manatee counties to look more closely at filings

According to the Tribune’s review of 1,994 circuit court records, the firm filed initial legal documents for 323 foreclosure lawsuits in October. That was second only to the Law Offices of David J. Stern, a Broward County-based foreclosure firm that filed 352 foreclosure cases in October. Florida Default Law Group operates in numerous counties in Florida, but it’s not clear how many lawsuits it files outside of Hillsborough County.
Recently, mortgage servicing companies have been filing about 2,000 initial foreclosure documents every month in Hillsborough County Circuit Court. To handle the overwhelming caseload, an army of lawyers, paralegals and clerks at big foreclosure law firms have streamlined the art of separating homeowners from their homes.
In the streamlining, distressed homeowners such as 75-year-old Janice Winemiller of Sarasota sometimes get hurt. Florida Default Law Group charged her more than $4,000 for delivery of legal documents, according to her nonprofit legal aid lawyer. The firm couldn’t substantiate the fees.
Dubbed foreclosure mills by some in the industry, these companies have turned the job into a factorylike process. Speed is the key to their success. “The only way their business model works is if they don’t lay eyes on the lawsuit,” said Jim Kowalski, a Jacksonville lawyer who has litigated against Florida Default Law Group.
Four firms, 1,049 filings; Few areas of the legal field are so dominated by a handful of players as foreclosure law. Florida Default Law Group is one of four foreclosure mills operating in Florida that appear to be winning the lion’s share of business from lenders or their representatives. Along with Florida Default, other big firms include the law offices of David J. Stern in Plantation, the law offices of Marshall C. Watson in Fort Lauderdale and Shapiro & Fishman in Boca Raton.

Combined, those four industry heavyweights filed 1,049 foreclosure cases in October, or 53 percent of all new foreclosures filed in Hillsborough County that month. Florida Default filed 323 new foreclosure cases in October, second only to the 352 cases filed by David J. Stern.
